Types of Charges

These charges usually begin in two different ways. An aggrieved person makes a complaint against a spouse, partner, date or family member the day after a disturbance. With little or no other evidence, the police make the arrest and the prosecutor files charges including a protective order barring the accused from alleged victim's home. Where the accused is a spouse or domestic partner, this can mean moving out of one's home and being cut off from children and denied use of property.

The other way the charges occur is when police are called to a home in the middle of an argument. With little discussion, the police are likely to haul the accused off in handcuffs to be booked. You could be charged with a misdemeanor or felony, based on the circumstances in the case.

Vigorous Defense in Your Time of Need

We understand you may be hurt and upset by the events that have occurred. We know that there are two sides to every story and we will make sure your side is heard. We will seek to remedy matters and guide you against pitfalls that may cause you more trouble. For instance if there is a protective order against you going to your home, you must not go even if your spouse or partner invites you back. The police may arrest you for violating a protective order and your spouse's invitation will provide no defense. Your proper action is to get the protective order lifted before returning. We offer a free initial consultation to discuss your charges. Contact us today.
